San Antonio, Texas – On a day that should have celebrated democracy, things took a troubling turn at a local polling site. As early voting kicked off across the state on Monday, a concerning incident unfolded at the Johnston Branch Library in the Southwest Side of San Antonio, where a 63-year-old man, Jesse Lutzenberger, was arrested for allegedly assaulting a 69-year-old election clerk.
It all began when Lutzenberger arrived at the polling site sporting a red hat with a slogan that showed support for former President Donald Trump. As it’s against state law to wear clothing or accessories that advocate for a candidate or political issue inside polling locations, a diligent election clerk politely asked him to remove the hat. This request came in accordance with the Texas Election Code, which prohibits any form of electioneering within 100 feet of the voting area.
Initially, Lutzenberger seemed to comply, taking off the hat and casting his vote. It appeared that everything was settled. However, as he made his way out of the library, he put the hat back on. This prompted the clerk to approach him again, reminding him that he was still within the polling area and needed to take it off.
Unfortunately, what happened next was alarming. Lutzenberger, instead of simply removing his hat once more, allegedly “threw several punches right at the face of the victim,” as described by Bexar County Sheriff Javier Salazar. Just moments later, the sheriff’s deputies were called to the scene to handle the situation, arriving around 6:25 p.m. Authorities reported that the injured clerk received medical attention on-site from emergency medical technicians before returning home.
Law enforcement soon tracked down Lutzenberger at his home on Dartmoor Street, where he was taken into custody. The seriousness of the crime cannot be understated, as Lutzenberger now faces a third-degree felony charge for injury to an elderly person, a charge that comes with potential penalties of up to ten years in prison and a hefty fine of up to $10,000.
Bexar County District Attorney Joe Gonzales emphasized his office’s firm stance against such behavior, promising that they would “vigorously prosecute” Lutzenberger and anyone else who partook in these kinds of actions at polling sites. He made it clear: “The right to vote is sacrosanct in our country and the bedrock of our democracy. But no one has the right to assault, threaten, harass or intimidate an election employee or voter.” The underlying message? Voting should be a safe and respected process.
