On October 5, around mid-day, agents observed a black Nissan Sentra making its way north on the west access road of Interstate 35. Little did they know, this routine check would lead to a series of events that shed light on the ongoing issues of migration and smuggling in the area.

The agent noted that the vehicle matched a common pattern often used by smugglers. Reports indicate that smugglers frequently bypass the I-35 checkpoint during this time of day, likely trying to exploit the uptick in traffic and the changeover of agents. This particular strategy often allows them to blend in with the ordinary commuter flow, which includes ranchers and oilfield workers. The agent decided to pull over the Nissan near mile marker 31, where they made contact with the driver, identified as Colin Martin Grace.

Feeling the Pressure

As the agent approached the vehicle, they noticed that there were four other occupants inside. The passengers appeared visibly nervous, raising a red flag for the authorities. After conducting a quick investigation, it became clear that these individuals were migrants, leading to further inquiry into Grace’s intentions.

According to the affidavit, he had traveled from San Antonio to Laredo the day before to spend time with his girlfriend and her family. While at a tire shop, he claimed that he was approached by what he referred to as a “family” who asked for a ride. Grace stated that he asked them if they were in the country illegally, to which one of them responded affirmatively.

According to Grace, he was only trying to help when he agreed to provide them with a ride for a fee of $60 to cover gas expenses. He insisted that he was just a good Samaritan trying to help out those in need. “There was no coordination or planning beforehand,” he stated, emphasizing his intentions to assist the family who had given him directions until the agent intervened.

While Grace’s intentions may have seemed noble, the legal implications of transporting undocumented migrants are complex. In light of this interaction, he was arrested and charged with transport, attempt to transport, and conspire to transport migrants.
